Case Description
On April 12, 2022, in Mariupol, the occupied part of the Donetsk region, four Ukrainian citizens were taken prisoner by Russian military personnel: Sergey Mishchenko, Artem Zhura, Denis Sivets, and Gennady Trufin, servicemen of the mortar battery of the 36th Separate Marine Brigade of the Armed Forces of Ukraine. They were accused of cruel treatment of the civilian population, intentional damage to other people's property, and attempted murder of two or more persons committed by an organized group, in a manner dangerous to the public, motivated by political and ideological hatred. Sergey Mishchenko and Denis Sivtsov were also accused of organizing these crimes. A separate case was initiated against Sergey Mischenko, commander of a mortar battery of the 36th Separate Marine Brigade of the Armed Forces of Ukraine, on charges of attempted murder of two or more persons, intentional damage to property, and cruel treatment of the civilian population. Exacerbating circumstances included committing the crime in a manner dangerous to the public, as part of an organized group, and for reasons of political and ideological hatred. According to the Russian investigation, in February 2022, Mishchenko, being at a combat position in the village of Shirokino of the Volnovakha district, gave orders to his subordinate mortar crews to shell civilian infrastructure and residential buildings in the village of Sakhanka of the Novoazovsk district. As a result, the gas distribution and pumping stations, as well as a vehicle whose driver was wounded, were damaged. The total amount of damage amounted to more than 1 million rubles. On December 15, 2025, the Supreme Court of the Donetsk People's Republic found Sergey Mishenko guilty and sentenced him to 22 years of imprisonment to be served in a strict regime correctional colony.
