Case Description
On May 18, 2022, during hostilities at the Azovstal plant in Mariupol, Donetsk Oblast, a group of more than 300 people left the plant's territory, laid down their arms, and surrendered to Russian military personnel. Among them were ten Ukrainian citizens, servicemen of the Azov regiment: Artem Vyshnyak, Ivan Nozhechkin, and their subordinates: Sergey Samokhal, Sergey Gaykovich, Semyon Severin, Dmitry Klusenko, Yevgeny Lavrenko, Denis Fedirko, Yegor Yakovenko, and Dmitry Kucheryavyy. Later, criminal cases were opened against them for attempted murder of two or more persons using a generally dangerous method motivated by hatred and enmity, use of prohibited means and methods in an armed conflict, and intentional damage to another's property. According to the Russian investigation, from March 7 to April 15, 2022, on the orders of Vyshnyak and Nozhechkin, the military fired mortars at residential buildings and socially significant objects of Mariupol's civilian infrastructure. More than 100 shots were fired, damaging three houses. All citizens managed to save themselves by hiding in shelters. On March 22, 2024, the Supreme Court of the Donetsk Republic found the defendants guilty and sentenced them to imprisonment for terms ranging from 22 years and 2 months to 22.5 years in a strict regime colony. The sentence was not appealed and entered into legal force. On February 5, 2026, Denis Fedirko was released during the next exchange of prisoners of war between Russia and Ukraine. Criminal cases were also opened against Dmitry Kucheryavyy for "participation in a terrorist community" of the Azov battalion and "receiving training for the purpose of carrying out terrorist activities," as well as for attempted murder of two or more persons using a generally dangerous method motivated by hatred and enmity, use of prohibited means and methods in an armed conflict, and intentional damage to another's property. According to the Russian investigation, in March 2022, Kucheryavyy, together with his comrades, carried out a mortar attack on the village of Berdyanskoye in the Mangush municipal district of the Donetsk People's Republic. As a result of the shelling, a married couple managed to take cover from the fragments of exploding mines, and three residential houses were damaged. The case of participation in the terrorist community "Azov" was separated into a separate proceeding. On September 4, 2024, the Southern District Military Court found Dmitry Kucheryavyy guilty and sentenced him to 18 years of imprisonment. By partially combining this with the verdict of the Supreme Court of the "DPR" from March 22, 2024, the court imposed a final sentence of 29 years of strict regime imprisonment. The sentence was not appealed and entered into legal force. On May 30, 2025, the Supreme Court of the Donetsk People's Republic found Dmitry Kucheryavyy guilty and sentenced him to 29 years and 4 months of imprisonment with serving the sentence in a strict regime correctional colony.
