Case Description

In Mariupol, in the occupied Donetsk region, on May 18, 2022, during hostilities at the Azovstal plant, a group of more than 300 people left the territory of the plant, laid down their arms and surrendered to Russian military personnel." 4. Among them are ten Ukrainian citizens, servicemen of the 'Azov' regiment: Artem Vyshnyak, Ivan Nozhchikin, and their subordinates: Sergey Samokhal, Sergey Gaykovich, Semyon Severin, Dmitry Klusenko, Yevgeny Lavrenko, Denis Fedirko, Yegor Yakovenko, and Dmitry Kucheryavyy. Later, a criminal case was opened against them for attempted murder of two or more persons using a generally dangerous method, motivated by hatred and enmity, use of prohibited means and methods in an armed conflict, as well as intentional damage to another's property. According to the Russian investigation, from March 7 to April 15, 2022, at the orders of Vyshnyak and Nozhechnikov, the military shelled residential buildings and socially significant objects of civil infrastructure in Mariupol with mortars. More than 100 shots were fired, damaging three houses. All citizens managed to escape by hiding in shelters. On March 22, 2024, the Supreme Court of the Donetsk Republic found the defendants guilty and sentenced them to imprisonment for terms ranging from 22 years and 2 months to 22.5 years in a strict regime colony. The verdict was not appealed and entered into legal force. On February 5, 2026, Denis Fedirko was released during the next exchange of prisoners of war between Russia and Ukraine.
