Case Description
In Mariupol, in the occupied Donetsk region, in May 2022, a 28-year-old Ukrainian citizen, commander of a mortar in military unit 3057 of the National Guard of Ukraine, the "Azov" regiment, Yuriy Dmitriev, was taken prisoner by Russian servicemen. A criminal case was opened against him for cruel treatment of the civilian population, the use of prohibited means and methods in an armed conflict, and murder committed by a group of persons in a generally dangerous manner motivated by ideological and political hatred. According to the Russian investigation, from March 10 to 15, 2022, Dmitriev, carrying out an illegal order from the command, fired at least 10 shots from a BM-37 82 mm mortar at a grain storage facility located on the outskirts of Mariupol. As a result, a man who was not involved in the armed conflict received fatal injuries. On May 6, 2023, the serviceman was released during a prisoner exchange between Russia and Ukraine. On February 26, 2025, the Supreme Court of the Donetsk People's Republic found Yuriy Dmitriyev guilty and sentenced him in absentia to 24.5 years in a strict regime penal colony. He was also placed on the international wanted list. The verdict was not appealed and entered into legal force.
