Case Description

In Moscow, near Pushkin Square on March 6, 2022, two friends from Omsk were detained - Anton Zhuchkov and Vladimir Sergeev. Molotov cocktails were found in Sergeyev's backpack. During their detention, Anton and Vladimir managed to take lethal doses of methadone. Therefore, they were first taken to the hospital's intensive care unit. A week later, on March 17, the Khamovnichesky District Court of Moscow sent the friends to a pre-trial detention center. Initially, a criminal case was initiated for 'attempted hooliganism with the use of weapons', but later the charge was reclassified to 'preparation of a terrorist act'. According to the investigation, no later than February 24, 2022, Zhuchkov and Sergeyev formed a firm belief in the illegality of conducting the special military operation <...>, in connection with which Sergeyev proposed to Zhuchkov to commit a terrorist act in the center of Moscow" - they allegedly wanted to set fire to an empty prisoner transport vehicle. Zhuchkov was also charged with "selling" methadone, lethal doses of which his friends took upon arrest. Investigators claimed that taking drugs was "part of an assignment from the Ukrainian special services. Vladimir Sergeev admitted that before committing suicide, he wanted to set fire to empty police vans as a protest against the war. These testimonies were given under pressure and without a lawyer. At the police station, the young men were tortured - doctors at Sergeev's recorded beatings: bruises of soft tissues of the head, multiple abrasions on the face." Zhuchkov also reported about torture - after the detention, security forces took off his shoes and beat him with a stun gun. The men themselves said that they planned to commit public suicide at an anti-war rally in Moscow to express their protest against the attack on Ukraine. On April 20, 2023, the 2nd Western District Military Court found Anton Zhuchkov and Vladimir Sergeev guilty and sentenced Zhuchkov to 10 years in prison, 3 years Zhuchkov will spend in prison, 7 - in a strict regime colony, Sergeev to 8 years in prison. Similarly, for the first 3 years, Sergeev will serve his sentence in prison, and the remaining 5 years in a strict regime colony. On September 27, 2023, the Appellate Military Court reduced the prison terms of both defendants by two months.
