Case Description

In Mariupol, the occupied part of the Donetsk region, in April and May 2024, military personnel of military unit 3057 of the Eastern Operational-Territorial Association of the National Guard of Ukraine, the "Azov" regiment, Leonid Hlushchenko, Oleh Ponomarenko, Yevhen Horaynov, Kostiantyn Oleinik, Vadym Tsyholan, Serhii Shchepkyv, Mykola Shcherbatov, Yan Serhiienko, Illia Voronych, and Artem Filin, fell into captivity with Russian military personnel. Criminal cases were opened against them for cruel treatment of the civilian population, the use of prohibited means and methods in an armed conflict, attempted murder of two or more persons committed by a group of persons using a generally dangerous method, motivated by ideological and political hatred, and intentional damage to another's property using a generally dangerous method. According to the Russian investigation, from February 25 to March 19, 2022, Ukrainian military personnel allegedly shelled residential buildings in Mariupol using a 122-mm towed howitzer. As a result, five houses were damaged, the amount of damage is 3 million rubles. There are no casualties among civilians. 18 March 2024, the Supreme Court of the Donetsk People's Republic found the defendants guilty and sentenced them to lengthy prison terms. The verdict was not appealed and entered into legal force.
