Case Description
On October 3, 2024, in the Kursk region, during hostilities, citizens of Ukraine, servicemen of the 21st separate mechanized brigade of the Armed Forces of Ukraine - 24-year-old Vladimir Gavryles, 25-year-old Vladimir Marcinkiewicz, 49-year-old Andrey Kukharishin, 34-year-old Andrey Kucheruk, and 47-year-old Viktor Nedashkovsky - were taken prisoner by Russian servicemen. A criminal case was initiated against him for committing a terrorist act by a group of persons by prior conspiracy, resulting in significant damage. According to the Russian investigation, from September to October 3, 2024, Gavryles, Marcinkiewicz, Kukharishin, Kucheruk, and Nedashkovsky, as part of the Armed Forces of Ukraine units, illegally invaded the territory of Korenevsky and Glushkovsky districts of the Kursk region. They were armed with AK-74 assault rifles and moved on infantry fighting vehicles Strf 90 and armored vehicles "Kazak". Being on the said territory, they "intimidated local residents, illegally occupied private residential houses, hindered the evacuation of civilians, and repeatedly opened fire on Russian servicemen and the civilian population." On April 29, 2025, the 2nd Western Military District Court found the defendants guilty and sentenced Gavryles, Marcinkiewicz, Kukharishin, and Nedashkovsky to 16 years of imprisonment each, and Kucheruk to 15 years of imprisonment. For the first three years, they will serve their sentences in prison, and the remaining part - in a strict regime correctional colony. The verdict was not appealed and entered into legal force.
