Case Description
In Voronezh, at the end of June 2022, 35-year-old local resident Andrey Biryukov was detained. He was accused of publicly "justifying terrorism" and "calling for extremist activity. The reason for the criminal prosecution was posts on VKontakte about the criminal case of Nadezhda Belova, who had previously been prosecuted under the article on justification of terrorism. The investigation saw calls for extremist activity in the phrase wishing "death to Russia and the Russian people. According to Biryukov's mother, the real reason for the persecution could have been the man's anti-war stance. It is reported that Andrey deleted his VKontakte page back in April 2022, before the criminal case was opened. On July 29, 2022, the defendant in the case was placed in a pre-trial detention center. On November 9, 2022, the 2nd Western Military District Court found Andrey Biryukov guilty and sentenced him to 3.5 years in a general regime penal colony. On January 23, 2023, the Appellate Military Court upheld the sentence. In June 2023, another criminal case was opened against Andrey Biryukov for justifying terrorism and calls for extremism. The reason for the second criminal prosecution was Biryukov's speech in the appellate court regarding the first case. According to the resolution on the initiation of a criminal case, Biryukov on January 23, 2023, being in the SIZO-3 of the Federal Penitentiary Service of Russia, in an open court hearing stated: "I do not consider Putin's fascism to be legitimate, I do not consider it a state. The verdict was not appealed and entered into legal force.
