Case Description
On January 31, 2024, a search was conducted in Moscow at the home of local resident, author of the group 'Pre-revolutionary Sovietchik' and poet Vyacheslav Malakhov. The security forces seized his phone, router, laptop and external drive from him. After that, the man was taken to the department of the internal affairs department for the Northern Administrative District of Moscow and detained for 48 hours until the court for the selection of a preventive measure. FSB opened a criminal case against Malakhov for "repeated discrediting of the army." 3. The reason for the criminal case was a post in Malakhov's Telegram channel from September 8, 2023, which begins with the phrase "no one wants to fuck your withered ass, old man, relax already and calm down." Later, a new episode was added to the case: a post from Malakhov's Telegram channel from September 12, 2023: 'Russia: you want to attack us and kill us. Ukraine: we don't want anything like that. Russia: attacks Ukraine. Ukraine: and now we want to attack you and kill you. Russia: Now that's more like it!" Earlier, in August 2023, the Savelovsky District Court of Moscow fined Malakhov under the article on discrediting the army due to posts on VKontakte. On June 11, 2024, Judge Diana Mischenko of the Khamovniki District Court of Moscow decided to change jurisdiction and transfer the case to the Petrogradsky District Court of St. Petersburg, justifying this decision by stating that the second episode of the "crime" was committed on the territory of the Petrogradsky District Court of St. Petersburg. 24 October 2024, the Khamovnichesky District Court of Moscow found Vyacheslav Malkhov guilty and sentenced him to two years in a general regime colony. The court also prohibited him from administering internet pages for two years after serving his sentence. On April 19, 2024, the Moscow City Court left the sentence in force.
