Case Description

1. A criminal case was initiated against Vladislav Krenik, a serviceman from Omsk, on the charge of desertion during mobilization. The exact date of the case initiation and his detention are unknown. As a preventive measure during the investigation, he was placed under a written undertaking not to leave. In November 2022, Krenik learned that his military unit would be sent to war in Ukraine. After that, he submitted a report to his commander, in which he informed about his pacifist beliefs and requested to be transferred to alternative civilian service (ACS). In his appeal, the mobilized serviceman noted that he "does not want to kill people" in the war. He was denied ACS. Krenik left the military unit, after which he was placed in a psychiatric clinic, and upon being discharged, he was detained by military police. The mobilized serviceman insisted that he did not evade service and had applied to the prosecutor's office and the human rights commissioner with requests to transfer him to ACS. On December 27, 2023, the Omsk Garrison Court found Vladislav Krenik guilty, but at the same time, it increased the punishment from Part 3 of Article 338 of the Criminal Code of the Russian Federation (desertion during mobilization) to Part 5 of Article 337 of the Criminal Code of the Russian Federation (abandonment of a military unit during mobilization for a period exceeding one month) and sentenced him to five years in a penal colony-settlement. The verdict was not appealed and entered into legal force.
