Case Description
On March 21, 2022, in Taganrog, Rostov region, security forces conducted a search of local resident Vitaly Mishin in a case of "fakes" about the Russian army motivated by political hatred. His mobile phone and two hard drives were confiscated. As a preventive measure, Mishin was assigned a written undertaking not to leave and to behave properly. The reason for the criminal prosecution was a comment in the "Rostov-Glavny - Rostov-on-Don News" community on the VKontakte social network under a post about a car rally in support of the Russian military: "Support our army in that it kills the civilian population of Ukraine." "Support her in that she called for help from the Kadyrovites, because she herself *** in many aspects is fighting against the vsu!»." According to the investigation, as well as the results of a linguistic examination, the comment contained "deliberately false, untrue information" about the goals of the Russian Armed Forces' presence on the territory of Ukraine and what exactly they are doing there. In court, the defendant's neighbors also testified against the resident of Taganrog. According to them, the man 'repeatedly spoke negatively about the current authorities and the President of the Russian Federation because he receives small payments from the state.'" 2. They also told the court that the defendant 'has a negative attitude towards military personnel from the Chechen Republic.' Additionally, in communication with neighbors, he expressed 'dissatisfaction with the conduct of the special military operation on the territory of Ukraine, believing that the Armed Forces of the Russian Federation are committing murders of the civilian population of Ukraine and in general they are carrying out the occupation of Ukraine.' "August 10, 2022, the Taganrog City Court found Vitaly Mishin guilty and sentenced him to 5 years of imprisonment with a 2-year probationary period and deprivation of the right to engage in activities related to website administration for one year. October 18, 2022, the Rostov Regional Court upheld the verdict.
