Case Description

In May 2023, a 23-year-old activist from Dagestan, Ulkar Gashimova, was detained at Sheremetyevo Airport in Moscow. She was planning to fly from Russia to the Netherlands via Belgrade to her fiance Anton Kolomitsyn. After her detention, a protocol on an administrative offense was drawn up against her under the article on disobedience to a representative of authority when crossing the border. According to the protocol, the activist "was a member of the WhatsApp and Signal messenger communities aimed at discrediting the Russian Federation and supporting the Armed Forces of Ukraine, with threats of physical violence against employees of the power departments of the Russian Federation." On May 5, Natalia Kutyrina, a magistrate of Justice of the Peace Court No. 358 of the Khimki District Court of the Moscow Region, arrested Gashimova for 10 days. Before her release from the detention center, employees of the 3rd Department of the Internal Affairs Directorate of the Mytishchinsky Police Department of the Ministry of Internal Affairs of Russia drew up another protocol against Gashimova - under the article on disobedience to police officers: the girl allegedly refused to show her documents and follow to the service vehicle in which she was to be taken to the police station. On May 15, Judge Eleonora Oftayeva of the Mytishchinsky City Court of the Moscow Region sentenced her to 15 days of administrative arrest. After serving her sentence under the second protocol, Gashimova was sent to Dagestan under escort by plane. She was accused of justifying terrorism and calling for extremism. Presumably, the reason for the criminal prosecution was publications in which Gashimova, according to the investigation, threatened Russian military personnel with reprisals, and also claimed that part of Dagestan historically belonged to Azerbaijan. Initially, Gashimova was placed under house arrest, but later the measure of restraint was tightened and she was sent to a pre-trial detention center. On October 8, 2024, the Southern District Military Court found Ulkar Gashimova guilty and sentenced her to 4 years and 6 months in a general regime colony. On February 27, 2025, the Appellate Military Court upheld the verdict.
