Five criminal cases of repeated 'discrediting' of the army were opened against local resident Sergey Tokhteyev in Vladivostok in February 2023, which were later combined into one. The reason for the criminal prosecution was anti-war tweets. According to the conclusion of the psychological and linguistic examination, all the posts attributed to Tokhtayev contain signs of "convincing the addressee of the negative nature of the goals of the execution of the powers of the state bodies of the Russian Federation, that is, discrediting. Previously, in June 2022, the musician was fined 30 thousand rubles under an administrative article on 'discrediting': the reason was pictures and comments on VKontakte, where, among other things, there was criticism of the Z and V military symbols, as well as information about the tragedy in Bucha. On June 22, 2023, Tokhteyev was brought in as a defendant, after which he was released under a written undertaking not to leave and to behave properly. On June 28, 2023, Judge Oleg Khrenkov of the Firstorechensky District Court of Vladivostok granted the investigator's petition to place Tokhteev in a hospital for a comprehensive forensic psychological and psychiatric examination for a period of 30 days. The petition was justified by the fact that "it is impossible to determine the level of disorders identified during the first examination and the degree of their severity in outpatient conditions. On August 17, he was placed in a hospital. On January 23, 2024, Judge Oleg Khrenkov of the Pervorechensky District Court of Vladivostok found Sergey Tokhteev guilty and sentenced him to a fine of 120 thousand. rubles. As an additional punishment, he was prohibited from administering websites for 3 years and his mobile phone was confiscated. The verdict was not appealed and entered into legal force.
