Case Description
In September 2022, a mining foreman named Roman Ivanishin was mobilized in the city of Shakhtyorsk, Sakhalin Oblast. He served in the 39th separate guards motorized rifle Red Banner brigade, stationed on Sakhalin Island, under mobilization. In June 2023, in the area of the village of Stepnoye in the Volnovakha district of the occupied Donetsk region, Ivanishen was taken prisoner. He spent six months in captivity with the motorized infantry and returned to his homeland in early January 2024 as part of a group of 248 Russian military personnel who were exchanged. In September 2024, Ivanishina was arrested on Sakhalin and accused of attempting to voluntarily surrender to captivity, surrendering to captivity, and desertion, committed under conditions of combat operations or mobilization. According to the investigation, the former miner twice attempted to surrender to the Ukrainian Armed Forces—once successfully. In addition, he allegedly deserted from the 39th Separate Guards Motorized Rifle Red Banner Brigade. The reason for the criminal prosecution could have been a video posted on the internet, where a serviceman spoke out against the "SVO" and claimed that he and his comrades did not want to fight and were fleeing from their positions: "Do not send your loved ones - sons, husbands. There is very heavy mortar and machine gun fire. People are demoralized, no one wants to fight. Many have already left their positions and fled home — those who managed to cross the border and get home, and people are intercepted on the way. Many want to leave and surrender — the command doesn't allow it, sends them to the trenches, people sit in the mud there. A general atmosphere of fear and confusion reigns at the positions — what to do next, Ivanisin said in the video. The military court in the occupied Donetsk region did not try Ivanishina, instead sending the case materials to his place of residence in Yuzhno-Sakhalinsk. In September 2024, the garrison military court of Yuzhno-Sakhalinsk sent the materials for jurisdiction to the capital. On April 11, 2025, the Yuzhno-Sakhalinsk Garrison Military Court found Ruslan Ivanishen guilty and sentenced him to 15 years in a strict regime colony.
