Case Description

Russia's Investigative Committee opened a criminal case in February 2024 against Colonel Mykola Dzioman, commander of the 138th Air Defense Missile Brigade (military unit A4608) of the Armed Forces of Ukraine, for committing a terrorist act resulting in death. According to the Russian investigation, on February 23, 2024, Colonel Dzyaman gave his subordinate servicemen an illegal order to destroy an aircraft of the Aerospace Forces of the Russian Federation, which was patrolling Russian airspace, was not intended for combat operations, and was not armed. As a result, 10 crew members died, and the plane was destroyed. On June 17, 2024, the Khamovnichesky District Court of Moscow granted the investigation's request for Daria's in absentia arrest. The term of arrest is calculated from the moment of his extradition to the territory of the Russian Federation or from the moment of his detention on the territory of the Russian Federation. He was placed on federal wanted list. On January 22, 2025, the Southern Military District Court found Nikolai Dziaman guilty and sentenced him in absentia to life imprisonment in a strict regime colony. He was placed on the international wanted list. The verdict was not appealed and entered into legal force. Later, in the Bryansk region, a second criminal case was opened in absentia against Colonel Dziaman - he was accused of committing a terrorist act that resulted in the death of a person, committed by a group of persons by prior conspiracy. According to the investigation, on May 13, 2023, servicemen of the 138th Air Defense Missile Brigade, following Dzyaman's order, secretly deployed the Patriot air defense system in the area of the settlement of Berezovaya Gata in the Chernihiv region of Ukraine. Under the personal leadership of Dziaman, they carried out targeted missile launches at Russian military helicopters and airplanes that were in the airspace of the Russian Federation on the territory of the Bryansk region. As a result, two Mi-8 helicopters, a Su-34 frontline bomber and a Su-35 fighter were shot down, which resulted in the death of 9 crew members and damage to the Ministry of Defense of the Russian Federation in the amount of more than 4.25 billion rubles. On December 4, 2025, the 2nd Western Military District Court found Nikolai Dzyaman guilty in absentia and, by the aggregate of sentences, sentenced him to life imprisonment, with the first 9 years to be served in prison, and the remainder in a strict regime penal colony. The court also satisfied civil claims and recovered more than 4 billion from Dzyaman. rubles to the benefit of the Ministry of Defense and more than 14 million. 4. rubles as compensation for moral damage to the victims.
