Case Description
In Moscow, anti-war activist Maksim Lypkan submitted an application for a rally called "A Year of Hell" in early February 2023. The event, conceived by Lypkan, was directed against Vladimir Putin's policies and was supposed to take place on Lubyanskaya Square on February 24, 2023 - the anniversary of Russia's military invasion of Ukraine. The Moscow City Hall refused to hold the action, citing the "epidemiological situation" due to the COVID-19 pandemic." "The next day after the refusal, Lypkanya was detained in the building of the Leningrad Station." He was taken to a police station and a protocol on an administrative offense was drawn up under the article on discrediting the army due to a publication in Telegram. On February 21, a search was conducted at Lypkani's place. The security forces turned off the light in the apartment and broke down the door. In relation to the activist, a case was opened about "fakes" about the Russian army. Lypskania's criminal prosecution was prompted by his interview with Radio Svoboda about the war and protest actions, as well as his posts on Telegram. On February 22, the Khamovnichesky District Court of Moscow sent the activist to a pre-trial detention center. On July 19, Lipkania was sent to the Psychiatric Center named after. V.P. Serb for a 30-day neuropsychiatric examination. In August, he was returned to the detention center again. On February 19, 2024, Judge Dmitry Venev of the Odintsovo City Court of the Moscow Region released Maksim Lypkan from criminal liability due to his health condition and ordered the activist to undergo compulsory treatment in a psychiatric hospital. June 11, 2024, Judge Marina Alyabusheva of the Moscow Regional Court upheld the decision.
