Case Description
In St. Petersburg on March 28, 2023, a 43-year-old local resident, Intigam Aliyev, while attempting to overtake a passing car, repeatedly driving into oncoming traffic, stopped his car at a pedestrian crossing, approached another driver, and stated his negative attitude towards Russians and Christians, calling them fascists because of the war in Ukraine and because of their attitude towards "Caucasians." The conversation was recorded on a dashcam. Then he got into his car and drove away. On the same day, Aliev was attempted to be detained by traffic police officers, but he resisted, fighting with traffic police inspectors, in particular using a wrestling move and knocking one of them down onto the asphalt. After this, Aliyev went into hiding. On April 4, 2023, officers of the Ministry of Internal Affairs detained him while attempting to leave the region. Immediately after Aliyev's detention, the Main Directorate of the Ministry of Internal Affairs showed a video with his "sincere apologies. Before the election of a measure of restraint, he was placed in a temporary detention facility. 6 April 2023 Aliyev was charged with insulting the feelings of believers and attacking a police officer. According to the investigation, Aliyev, using a minor pretext in the form of not giving him priority in traffic, expressed phrases containing an extremely negative (hostile) attitude towards representatives of a group of persons united by the sign of belonging to a religion - "Christians, which are offensive to Orthodox Christianity, thus humiliating the feelings of believers. He also struck at least 1 blow with his hand to the area of the left arm, at least 1 blow with his foot to the area of the right leg, and also, using wrestling techniques, threw the inspector (DPS) of platoon No. 1 of the first company of the OSB DPS of the GU MVD of Russia for g. over his back onto the asphalt surface. The St. Petersburg and Leningrad Region, and also inflicted on the second traffic police inspector at least 1 blow with his hand to the area of the left arm, at least 1 blow with his foot to the area of the right leg, thereby causing the victims physical pain, moral suffering and bodily injuries. The Primorsky District Court of St. Petersburg extended Aliyev's detention time to 72 hours. 8 April 2023, the Primorsky District Court of St. Petersburg, at the request of the investigation, chose Aliyev's measure of restraint in the form of detention. On November 10, 2023, the Primorsky District Court of St. Petersburg found Intigam Aliyev guilty and sentenced him to a fine of 250 thousand. rubles. Taking into account his detention, the court reduced the amount of the fine to 150 thousand. rubles. On April 18, 2024, the St. Petersburg City Court increased Aliyev's sentence to two years in a penal colony.
