Case Description
On April 5, 2022, a criminal case was opened in the occupied part of the Donetsk region regarding a missile strike on military units. Later, it was combined with 124 other cases of shelling of Russian territories. As part of this case, on April 10, 2024, charges were brought in absentia against Colonel Dmitry Khrapach of the Armed Forces of Ukraine. He was accused of murdering and attempting to murder two or more persons by a dangerous method in an organized group motivated by hatred and enmity; of cruel treatment of the civilian population and the use of prohibited methods in an armed conflict, as well as of intentionally damaging another's property." "According to the investigation, on 30 December 2022, Khrapach, being at combat positions in Konstantinovka, gave an order to shell the Kyiv district of Donetsk from multiple launch rocket systems. As a result of the impact of six missiles on the Victoria hotel complex, an employee of the military investigative bodies was killed, and the building was severely damaged. On July 24, 2023, he was put on the wanted list. On April 12, 2024, the Khamovnichesky District Court of Moscow chose a measure of restraint against Dmitry Khrapach in the form of detention in absentia. The measure of restraint will come into force from the moment of his detention on the territory of Russia or transfer to Russian law enforcement agencies. On August 28, 2023, the Supreme Court of the Donetsk People's Republic found Dmitry Khrapach guilty in absentia and sentenced him to life imprisonment with serving the sentence in a strict regime penal colony. Information about an appeal against the verdict is not available. No later than August 2024, a second criminal case was opened against Khrapach: he was accused of organizing terrorist acts and committing acts of terrorism that resulted in significant material damage and human casualties. According to the Russian investigation, Khrapach gave orders to carry out missile strikes on the Belgorod region, which resulted in the deaths of people and caused damage amounting to 4 million. 639 thousand 733 rubles. On September 4, 2024, the 2nd Western District Military Court also found Dmitry Khrapach guilty in absentia and, by combining the crimes, sentenced him to life imprisonment with serving the sentence in a special regime colony and a fine of 4 million rubles to the Russian Federation. The court ruled that the term of punishment should be calculated from the moment of his detention on the territory of the Russian Federation or extradition to Russia. January 15, 2025, the Appellate Military Court left the sentence unchanged.
