Case Description
In the city of Aniva, Sakhalin Oblast, no later than August 2023 (the exact date is unknown), a criminal case was opened against serviceman Denis Aglichev for refusing to participate in military or combat operations. The exact date the case was opened and the chosen preventive measure are unknown. According to the investigation, on August 22, 2023, Aglichev refused to go to the front, thereby putting "the principle of unified command into question, which has currently negatively affected the state of military discipline and order in the military collective." The investigation considered the "decree of Vladimir Putin on partial mobilization from 2022" as an aggravating circumstance for the committed crime. On January 11, 2024, the Yuzhno-Sakhalinsk Garrison Military Court found Denis Aglichev guilty and sentenced him to 2 years and 9 months in a general regime colony. On March 20, 2024, the 1st Eastern Military Circuit Court upheld the verdict. In the city of Aniva, Sakhalin Oblast, no later than August 2023 (the exact date is unknown), a criminal case was opened against 24-year-old serviceman Denis Aglichev for possession of fake documents and forgery during the mobilization period. The chosen preventive measure is unknown. According to the investigation, Aglichev, with the aim of being discharged from military service and fully released from the duties of military service, between March and May 2023 in Yuzhno-Sakhalinsk, purchased from unidentified persons knowingly fake official documents - a certificate and a medical-social expert assessment conclusion establishing his mother's disability and the need for her constant care due to her health condition. On May 10, 2023, that is, during the mobilization period, the serviceman submitted a report to the commander of the military unit for discharge from military service due to family circumstances, to which he attached the aforementioned knowingly forged documents. On April 3, 2024, the Yuzhno-Sakhalinsk Garrison Military Court found Denis Aglichev guilty and sentenced him to 4 years of imprisonment in a general regime colony. Taking into account that in January 2024, Aglichev had already been sentenced by the Yuzhno-Sakhalinsk Garrison Military Court for refusing to participate in combat operations, the court imposed a final sentence of imprisonment for a term of 6 years to be served in a general regime correctional colony. The verdict was not appealed and entered into legal force.
