Case Description
In the occupied Donetsk region, a criminal case was initiated in absentia against a 23-year-old citizen of Ukraine, a serviceman of the National Guard of Ukraine, Sergeant Andrey Barsky of military unit A-3057 of the "Azov" regiment, no later than March 2022. He was accused of cruel treatment of the civilian population, the use in armed conflict of means and methods prohibited by an international treaty of the Russian Federation, and murder committed by an organized group, in a generally dangerous manner, motivated by ideological and political hatred. According to the Russian investigation, in March 2022 in Mariupol, Barsky, following an illegal order from command, fired a mortar at a grain storage facility where civilians were located. As a result, a man who was not involved in the armed conflict received fatal injuries. On March 13, 2025, the Supreme Court of the Donetsk People's Republic found Andrey Barsky guilty and sentenced him in absentia to 24 years in a strict regime penal colony. The court also put him on international wanted list. The verdict was not appealed and entered into legal force. Andrey Barsky died in March 2022 during the fighting for Mariupol. On April 17, 2022, he was awarded the Order of Courage, 3rd class (posthumously)." He was buried on October 21, 2022, in the Alley of Heroes at Mikulinetsky Cemetery in Ternopil.
