Case Description
In early February 2023, poet Alexander Byvshev was detained in Oryol. The reason for the criminal prosecution was a poem published on a Facebook page, 'To the Russian Officer Corps, or a Rhetorical Question (Former Bolshevism)': 'Missiles are hitting Ukraine. The Kremlin rejected conscience and morality. Officer's honor, where are you? "Where is your Russian Stauffenberg?" The investigation claims that, by mentioning in his quatrain Wehrmacht Colonel Claus von Stauffenberg - one of the main participants in the July 20, 1944 conspiracy, who carried out an assassination attempt on Hitler - Byvshev was thereby calling for the assassination of Vladimir Putin. Buyshev was accused of propaganda and justification of terrorism, and was detained. In November 2023, Byvshev was given another charge under the article on calls for terrorism, and in December a new case was opened against him - for 'fakes' about the Russian army motivated by political hatred. The reason for the charges was a post in which Byvshev published a photo of a destroyed village 30 kilometers from Kyiv. In the publication, the man wrote that his aunt was born and studied there. March 19, 2024, Judge Anton Kakadeev of the 2nd Western Military District Court found Alexander Byvshev guilty and sentenced him to seven years in a general regime colony. On May 27, 2024, the Appellate Military Court slightly mitigated the sentence and imposed a punishment of 6 years 10 months in a general regime colony.
